Sec. 7. "Confined feeding operation" or "CFO" means any:

1. (1) confined feeding of at least:

   1. (A) three hundred (300) cattle;
   2. (B) six hundred (600) swine or sheep;
   3. (C) thirty thousand (30,000) fowl; or
   4. (D) five hundred (500) horses;
2. (2) animal feeding operation electing to be subject to IC 13-18-10;

3. (3) animal feeding operation that causes a violation of:

   1. (A) water pollution control laws;
   2. (B) any rules of the water pollution control board; or
   3. (C) IC 13-18-10; or
4. (4) animal feeding operation located outside of Indiana that would be a CFO if located in Indiana.
