Sec. 2. (a) The provisions of this article do not apply to the care of livestock and poultry used by a research facility that is regulated by the United States Department of Agriculture under the Animal Welfare Act (7 U.S.C. 2131 et seq. and 9 CFR Part 2, Subpart C).

(b) There is no violation of this article if:

1. (1) a person is unable to provide the required care due to an act of nature, such as a natural disaster; or
2. (2) care is provided or withheld in a manner prescribed by a veterinarian.
