Sec. 1. Applicants may request an exemption from a requirement in this article by submitting a written request to the department with the following information:

1. (1) The request must contain a detailed description of the basis for a requested exemption.

2. (2) The request shall be reviewed by the department with regard to:

   1. (A) a potential nuisance;
   2. (B) a hazard to public health or safety; or
   3. (C) estimated degradation of the environment.

3. (3) An exemption granted by the department must:

   1. (A) be in writing; and
   2. (B) clearly state the reason for the exemption.
