Sec. 1. An appeal of a determination shall be:

1. (1) in accordance with IC 4-21.5-3 and rules of the office of environmental adjudication; and
2. (2) made by filing a written petition for review with the office of environmental adjudication in accordance with IC 4-21.5- 3.

A copy of the petition shall be served on the commissioner concurrent with such filing.
