Sec. 9. Membership in ESP may be transferred to another entity at the same geographic location provided:

1. (1) the department is notified within ninety (90) days of the:

   1. (A) change in ownership or management; and
   2. (B) intent to maintain membership; and

2. (2) senior management commits to:

   1. (A) fulfilling the previous member's commitments; and
   2. (B) the requirements of the program for the remainder of the membership term by signing an updated membership application.
