Sec. 1. (a) This article regulates electronic waste (e-waste) through the following:

1. (1) Providing for the registration of facilities storing or processing electronic waste.
2. (2) Providing standards for storing or processing electronic waste.
3. (3) Providing cleanup and closure standards for storing or processing electronic waste.
4. (4) Providing financial assurance for the cleanup and closure of facilities storing or processing electronic waste.

(b) The purpose of this article is to implement the following statutes relative to electronic waste:

1. (1) IC 13-30-2-1(3) and IC 13-30-2-1(4) regarding the deposit of contaminants or solid waste upon the land.
2. (2) IC 13-30-2-1(5) and IC 36-9-30-35 prohibiting dumping, causing, or allowing the open dumping of garbage or of other solid waste.

(c) This article replaces all hazardous waste standards and requirements under 329 IAC 3.1 for e-waste that is being recycled, except:

1. (1) disposal or incineration requirements under 329 IAC 16-9-1; and
2. (2) export requirements.

(d) This article replaces all solid waste processing standards and permitting requirements under 329 IAC 11 for e-waste, except disposal or incineration requirements under 329 IAC 16-9-1.
