Sec. 21. (a) The owner or operator of a waste tire storage site or waste tire processing operation completing final closure of a facility shall:

1. (1) cease all storage or processing of waste tires;
2. (2) remove from the facility and properly dispose of all waste tires in accordance with this article, including all PTEs calculated under section 20.5 of this rule; and
3. (3) notify the department on a form provided by the department within thirty (30) days after completing the closure activities required by this subsection.

(b) Final closure is complete when the commissioner notifies the owner or operator of the waste tire storage site or waste tire processing operation in writing that:

1. (1) the department has received the notification required by subsection (a)(3);
2. (2) the final closure activities required by subsection (a)(1) and (a)(2) are complete; and
3. (3) for a waste tire storage site, the financial assurance required by 329 IAC 15-5 is no longer required to be maintained.

(c) The commissioner may approve an alternative method of closure other than the requirements of this section if the alternative method of closure provides protection of human health and the environment equivalent to this section.
