Sec. 5. "Nuisance" means one (1) or more of the following:

1. (1) Fugitive dust as defined at 326 IAC 6-4-1.
2. (2) Disease vectors.
3. (3) Uncontrolled litter.
4. (4) Odors.
5. (5) Fire.
6. (6) Fire hazard, as evidenced by an order from the state fire marshal that the property is not in compliance with the Indiana Fire Code as adopted by the fire prevention and building safety commission at 675 IAC 22.
