Sec. 3. The department, or its authorized representative, upon presentation of proper credentials, or by directive of the board, shall have a right to enter upon, to, or through public or private premises, subject to this article, to investigate, take samples, copy all records related to the management of used oil, and inspect for compliance with the requirements imposed under IC 13-15, IC 13-19, IC 13- 20, IC 13-22, IC 13-23, or this article, or to determine whether a violation or threatened violation exists, in accordance with any or all of the following purposes:

1. (1) To determine:

   1. (A) whether any person is subject to the requirements of IC 13-15, IC 13-19, IC 13-20, IC 13-22, IC 13-23; or
   2. (B) whether any person subject to the requirements of IC 13-15, IC 13-19, IC 13-20, IC 13-22, or IC 13-23 is in compliance with this article.
2. (2) To investigate conditions relating to used oil management or used oil management practices where the commissioner has a reasonable belief that a violation of IC 13-15, IC 13-19, IC 13-20, IC 13-22, IC 13-23, or this article is occurring or is about to occur.
3. (3) To determine whether there has been a violation of any of the provisions of IC 13-15, IC 13-19, IC 13- 20, IC 13-22, IC 13-23, this article, or any permit or order issued under IC 13-14, IC 13-15, or this article.
