Sec. 45. (a) "Surface impoundment" means a facility or part of a facility that:

1. (1) is a natural topographic depression, manmade excavation, or diked area formed primarily of earthen materials, although it may be lined with manmade materials;
2. (2) holds or is designed to hold an accumulation of liquid wastes or wastes containing free liquids; and
3. (3) is not an injection well.

(b) Examples of surface impoundments may include the following:

1. (1) Holding, storage, settling, and aeration pits.
2. (2) Holding, storage, settling, and aeration ponds.
3. (3) Holding, storage, settling, and aeration lagoons.
