Sec. 19. (a) Nonmunicipal solid waste landfills must ensure that:

1. (1) the concentration of methane generated by the facility does not exceed twenty-five percent (25%) of the lower explosive limit for the gases in facility structures, excluding gas control or recovery system components; and
2. (2) the concentration of methane gas does not exceed the lower explosive limit for the gases at the facility property boundary.

(b) Nonmunicipal solid waste landfills must implement a methane monitoring program approved by the commissioner to ensure that the standards in subsection (a) are met. The type and frequency of monitoring must be determined based on soil conditions, hydrogeologic conditions, and the location of structures and property boundaries.

(c) If methane gas levels exceed the limits in subsection (a), the permittee must:

1. (1) within twenty-four (24) hours notify the commissioner; and
2. (2) immediately implement all necessary steps to ensure protection of human health.
