Sec. 4. (a) The issuance of a permit does not:

1. (1) convey any property rights of any sort or any exclusive privileges to the permittee;

2. (2) authorize:

   1. (A) any injury to any person or private property;
   2. (B) invasion of other private rights; or
   3. (C) any infringement of federal, state, or local laws or regulations; or
3. (3) preempt any duty to comply with other state or local requirements.

(b) The owner, operator, and permittee of a solid waste land disposal facility and the owner or owners of the land upon which a solid waste land disposal facility is located shall be liable for any environmental harm caused by the facility.

(c) The permittee shall construct and operate a solid waste land disposal facility in accordance with the permit. The owner, operator, and permittee are equally responsible for complying with the conditions of the permit, the regulations, and the statutes.
