Sec. 11. If any information or arguments submitted during the public comment period appears to raise substantial new questions concerning a permit, the commissioner may conclude that one or more of the following actions is necessary for an informed decision:

1. (1) formulation of a new draft permit, appropriately modified;
2. (2) preparation of a fact sheet or revised fact sheet and reopening the comment period under 327 IAC 5-3-9; or
3. (3) Reopening or extending the comment period to give interested persons an opportunity to comment on the information or arguments submitted. In each case the notice required by 327 IAC 5-3-12 shall be given.
