Sec. 3. A nonindustrial wastewater treatment plant is classified based on the design population equivalent of the plant as follows:

1. (1) Class I-SP includes all waste stabilization ponds, whether controlled discharge or continuous discharge, regardless of flow.
2. (2) Class I includes wastewater treatment plants having a design population equivalent of less than two thousand (2,000).

3. (3) Class II includes wastewater treatment plants having a design population equivalent:

   1. (A) equal to or greater than two thousand (2,000); and
   2. (B) less than ten thousand (10,000).

4. (4) Class III includes wastewater treatment plants having a design population equivalent:

   1. (A) equal to or greater than ten thousand (10,000); and
   2. (B) less than or equal to forty thousand (40,000).
5. (5) Class IV includes wastewater treatment plants having a design population equivalent greater than forty thousand (40,000).
