Sec. 3. (a) The owner or operator must submit an application for a renewal permit to continue to operate a regulated a SMSS. The application must:

1. (1) be submitted on forms provided by the department;
2. (2) contain a current SMSS site plan, as described in section 1(b)(3) of this rule; and
3. (3) be submitted at least thirty (30) days prior to the expiration of the previous permit.

(b) The terms and conditions of an expired permit are automatically extended in full force and effect until the effective date of a renewal, if the:

1. (1) owner or operator has submitted a complete application for a permit renewal under this article at least thirty (30) days prior to the expiration of the permit; and
2. (2) commissioner, through no fault of the owner or operator, does not issue a permit renewal prior to the expiration date of the previous permit.

(c) Incomplete applications may be denied in accordance with IC 13-15-4-9.
