Sec. 6. (a) Except as provided in subsection (b), an individual NPDES permit issued under 327 IAC 5 is required for a discharge:

1. (1) to a receiving stream identified as an:

   1. (A) outstanding state resource water, as defined in IC 13-11-2-149.6; or
   2. (B) outstanding national resource water, as defined in IC 13-11-2-149.5; or
2. (2) that would significantly lower the water quality as defined in 327 IAC 2-1.3-2(50) of a water downstream of the discharge.

(b) A discharge to an:

1. (1) outstanding national resource water, as defined in IC 13-11-2-149.5; or
2. (2) outstanding state resource water, as defined in IC 13-11-2-149.6;

that consists only of stormwater may be permitted under a general permit if the commissioner determines the discharge will not significantly lower the water quality as defined in 327 IAC 2-1.3-2(50) of a water downstream of that discharge.
