Sec. 3. (a) In a general permit issued under this article, the commissioner may require a person who is subject to this article to:

1. (1) establish and maintain records;
2. (2) make reports;
3. (3) install, use, and maintain monitoring equipment or methods (including, where appropriate, biomonitoring methods);

4. (4) sample:

   1. (A) effluents;
   2. (B) internal wastestreams, where appropriate; or
   3. (C) other material; and

5. (5) provide other data, including, at a minimum:

   1. (A) raw materials;
   2. (B) catalysts;
   3. (C) intermediate products;
   4. (D) byproducts;
   5. (E) production rates; and
   6. (F) related process information;

at the locations, times, and in the manner that the commissioner may reasonably prescribe.

(b) Sampling of internal wastestreams under subsection (a)(4)(B) and the provision of other data under subsection (a)(5) are not required by the commissioner unless the data are:

1. (1) reasonably expected to facilitate:

   1. (A) the identification or quantification of pollutants that may be released to the environment from facilities operated by the person to whom the request is made; and
   2. (B) the commissioner's identification or quantification of the pollutants that could not reasonably be made by the commissioner in the absence of the requested information; or
2. (2) necessary to properly control wastewater treatment processes.
