Sec. 1. On and after November 1, 1995, this rule applies to shipbuilding or ship repair facilities that meet the following conditions:

1. (1) Are located in Clark or Floyd County and emit or have the potential to emit a total of one hundred (100) tons per year or more of volatile organic compounds (VOC) from all operations at the shipbuilding or ship repair facility.
2. (2) Are located in Lake or Porter County and emit or have the potential to emit a total of twenty-five (25) tons per year or more of VOC from all operations at the shipbuilding or ship repair facility.
