Sec. 2. The following definitions apply throughout this rule:

1. (1) "Clean wood" means untreated wood that has no paint, stains, coatings, glues, or any chemical treatment.

2. (2) "Distribute or sell" means to:

   1. (A) distribute;
   2. (B) sell;
   3. (C) advertise for sale;
   4. (D) offer for sale;
   5. (E) lease;
   6. (F) ship;
   7. (G) deliver for shipment;
   8. (H) release for shipment; or
   9. (I) receive and deliver, or offer to deliver.
3. The term does not include the distribution or sale by a manufacturer of an outdoor hydronic heater that is installed outside of Indiana.

4. (3) "Outdoor hydronic heater" means a fuel burning device:

   1. (A) designed to burn wood or other approved renewable solid fuels;
   2. (B) intended for outdoor installation or installation in structures not normally occupied by humans; and
   3. (C) that heats building space or water, or both, by the distribution, typically through pipes, of a fluid heated in the device, typically water or a water and antifreeze mixture.
5. (4) "Start-up period" means the time period beginning with flame stability after first charge of wood fuel and lasts no longer than two (2) hours. The term includes only initial start-up where no previous wood coal bed exists and does not include refueling.
