Sec. 17. Pursuant to the CAA, and if specified in a written agreement with the commissioner, a local air pollution control agency may perform some or all of the functions of the FESOP program. The commissioner and such a local air agency shall enter into an enforceable written agreement documenting the local air agency's and the department's relative FESOP program roles and responsibilities.
