Sec. 21. Pursuant to the CAA and if specified in a written agreement with the commissioner, a local air pollution control agency may perform some or all of the functions of the Part 70 permit program. The commissioner and such a local air agency shall enter into an enforceable written agreement documenting the local air agency's and the department's relative Part 70 permit program roles and responsibilities.
