Sec. 1. The following shall be exempt from the requirements of this rule:

1. (1) A new source or existing source that meets the criteria for an exemption under 326 IAC 2-1.1-3.

2. (2) Except for sources described in section 2(2) of this rule, a new or existing source subject to one (1) of the following:

   1. (A) A Part 70 permit under 326 IAC 2-7.
   2. (B) A federally enforceable state operating permit (FESOP) under 326 IAC 2-8.
   3. (C) A source specific operating agreement under 326 IAC 2-9.

   4. (D) A permit by rule under:

      1. (i) 326 IAC 2-10; or
      2. (ii) 326 IAC 2-11.
   5. (E) A registration under 326 IAC 2-5.5.
