Sec. 11. (a) The allowed emission rate for any regulated pollutant under this rule shall not be affected in any manner by the following:

1. (1) That portion of a stack height exceeding good engineering practice, as established in 326 IAC 1-7, that was not in existence by December 31, 1970.
2. (2) Any other dispersion technique not implemented before December 31, 1970.

(b) Subsection (a) shall not apply with respect to stack heights in existence before December 31, 1970, or to dispersion techniques implemented prior to that date.
