Sec. 1. The purpose of this article is to provide the following:

1. (1) The policy of the air pollution control board, to be followed by the department, in making public records available for public review and copying in accordance with IC 5-14-3 unless the information is determined to be confidential.
2. (2) The provisions for protecting legitimate interests in the confidentiality of certain information.
3. (3) The criteria to be used for determining the legitimacy of confidentiality claims in accordance with IC 5-14- 3.
4. (4) The procedures that the commissioner shall use in making determinations on the confidentiality of information.
5. (5) The form of confidentiality agreements required by IC 13-14-11-5 from employees of the department and from persons under contract to the department.
