Sec. 6. (a) Any owner or operator of an emission unit that is required to obtain a permit under section 1 of this rule shall submit a malfunction emission reduction program within one hundred eighty (180) days after a new emission unit commences operation.

(b) The program must include:

1. (1) the normal operating emission rate; and
2. (2) the actions that will be taken to reduce emissions in the event of a malfunction to an emission rate that will not contribute to the cause of the violation of the ambient air quality standards established in 326 IAC 1-3.

(c) The program must be based on the:

1. (1) best estimates of type and number of startups, shutdowns, and malfunctions experienced during normal operation of the emission unit or emission control device; and
2. (2) scope and duration of the conditions.

(d) The program is subject to review and approval by the commissioner.
