Sec. 5.2. A "chronic wasting disease positive area" means a county designated by the department where:

1. (1) there is a confirmed case of chronic wasting disease by a laboratory in the national animal health laboratory network; or

2. (2) the scientific model used by the department predicts the spread of chronic wasting disease in Indiana based on the:

   1. (A) location of positive cases;
   2. (B) knowledge of disease transmission in the Midwest; and
   3. (C) landscape characteristics of Indiana.
