Sec. 22. The division director may approve the use of plugging materials other than cement or bentonite chips as provided in section 20 of this rule if an owner or operator demonstrates the material:

1. (1) provides equal or greater protection to commercially minable coal resources and underground sources of drinking water; and
2. (2) prevents movement of any oil, gas, coal bed methane, and other fluids from the original formations.
