Sec. 23. The owner or operator shall cover the following structures with netting or other protective material designed to keep birds and flying mammals from entering the structure and coming into contact with production fluids:

1. (1) Concrete production fluid storage structures that are not completely covered with a concrete cover or other solid covering.
2. (2) Production fluid storage pits.
3. (3) Open top tanks used for the storage of produced fluids or liquid oilfield wastes.
