Sec. 40. "Unreasonable hazard to the safety of life or property" means a condition that is likely to:

1. (1) be caused by the design or construction of a project; and

2. (2) result during a regulatory flood in either:

   1. (A) the loss of human life; or
   2. (B) damage to public or private property to which the license applicant has neither ownership nor a flood easement.
