Sec. 9. (a) The ex parte rules of the commission in 170 IAC 1-1.5 do not apply to communications made in association with a filing under this rule.

(b) A filing under this rule and related communications shall not be deemed communications under 170 IAC 1-1.5-6, even if the filing is:

1. (1) withdrawn by the utility; or
2. (2) denied by the commission.
