Sec. 5.5. (a) Whenever work is to be performed in a right-of-way, an application for a permit shall be made. Applications for permits must be:

1. (1) submitted using the department's Electronic Permit System;
2. (2) signed by the property owner or an authorized representative; and
3. (3) accompanied by a permit application fee.

(b) Permit application fees are as follows:

1. (1) Six hundred dollars ($600) for a major commercial driveway permit.
2. (2) One hundred fifty dollars ($150) for a minor commercial driveway permit.
3. (3) One hundred fifty dollars ($150) for a sub-minor commercial driveway permit.
4. (4) Fifty-five dollars ($55) for a private driveway permit.
5. (5) Six hundred dollars ($600) for a major public approach permit.
6. (6) One hundred fifty dollars ($150) for a minor public approach permit.
7. (7) Fifty-five dollars ($55) for a right-of-way occupancy permit.
8. (8) Fifteen dollars ($15) for a miscellaneous permit.
