Sec. 6. A broadband access agreement must include provisions that comply with the requirements outlined in 23 CFR 710.405 and be:

1. (1) fully executed by the operator and the department; and
2. (2) approved by the state approving agencies before a permit is issued.

The operator may not perform any work within the department's right-of-way without a valid permit and fully executed agreement.
