Sec. 23. No permit may be issued for the installation of broadband as follows:

1. (1) No available space exists in the department's roadway for additional conduit.
2. (2) No available space exists in the department's limited access highway conduit for fiber optic cable.
3. (3) The proposed plans do not meet the department's requirements for installation of broadband or its facilities contained in this rule or IC 8-23-2.
