1. (a) The following are immune from civil liability for an act or omission occurring during a motorcycle operator safety education course that results in an injury or property damage:

   1. (1) The state of Indiana.
   2. (2) A regional training center contracted by the bureau or any other site approved by the commissioner to provide motorcycle driver education and training courses.
   3. (3) The owner of a site upon which a motorcycle operator safety education course is conducted.
   4. (4) An officer, agent, or employee of a person described in subdivisions (1) through (3).
2. (b) The immunity described in subsection (a) does not apply if the person committed gross negligence or willful or wanton misconduct.
