1. (a) A person that violates or fails to comply with an out-of-service order is subject to a civil penalty in accordance with federal law.

2. (b) A civil penalty assessed under this section:

   1. (1) must be collected by the clerk of the court and transferred:

      1. (A) to the motor vehicle highway account; or
      2. (B) to the bureau for deposit in the motor vehicle highway account; and

   2. (2) is a judgment subject to proceedings supplemental by the bureau.
