"Property owner" refers to a person that:

1. (1) owns property adjacent to a recreational trail; and

2. (2) is not a responsible party.

   For purposes of this section, a person that satisfies both subdivisions

3. (1) and (2) is a property owner even if the person owns any part of a fee simple interest in the corridor.
