1. (a) A CMGC or PDB may not replace a person identified as a person with which the CMGC or PDB proposes to enter into a subcontract for services under a contract without:

   1. (1) the approval of the department; and
   2. (2) a written determination by the department that a legitimate reason exists for the replacement.
2. (b) If a CMGC or a PDB violates subsection (a), the department may cancel the award of or may terminate the contract.
