This chapter applies to each:

1. (1) municipality; and

2. (2) county that:

   1. (A) does not have a consolidated city; and

   2. (B) receives notification from the department of environmental management that the county will be subject to storm water regulation under 327 IAC 15-13;

      that adopts the provisions of this chapter by ordinance.
