As used in this chapter, "electricity supplier" means a person, other than a municipally owned utility (as defined in IC 8-1-2-1 (h)), that:

1. (1) provides utility service to customers in Indiana; and
2. (2) is under the jurisdiction of the commission for the approval of rates and charges.
