1. (a) As used in this chapter, "sustained service interruption" means a service interruption that is at least five (5) minutes in duration.

2. (b) The term does not include the following, regardless of duration:

   1. (1) A planned service interruption that is:

      1. (A) initiated by an electricity supplier to perform scheduled activities, such as work related to:

         1. (i) system or facilities maintenance or upgrades;
         2. (ii) infrastructure improvements; or
         3. (iii) new construction; and
      2. (B) communicated to customers in advance.
   2. (2) A curtailment or interruption of service to a customer receiving service under an interruptible service tariff to the extent that the curtailment or interruption of service occurs in accordance with the customer's service agreement.
