Ind. Code § 8-1-32.3-12

"Utility pole"

As used in this chapter, "utility pole" means a structure that is:

  1. (1) owned or operated by:

    1. (A) a public utility;
    2. (B) a communications service provider;
    3. (C) a municipality;
    4. (D) an electric membership corporation; or
    5. (E) a rural electric cooperative; and
  2. (2) designed or used to:

    1. (A) carry lines, cables, or wires for telephony, cable television, or electricity;
    2. (B) provide lighting;
    3. (C) provide traffic control; or
    4. (D) provide signage.

      The term does not include a wireless support structure or an electrical transmission tower.
