As used in this chapter, "eligible utility" means:

1. (1) a public utility;
2. (2) a municipally owned utility; or

3. (3) a not-for-profit utility;

   that provides water or wastewater service to the public and is under the jurisdiction of the commission for the approval of rates and charges.
