As used in this article, "miscellaneous participating entity" means an entity that participates in the public employees' retirement fund, except:

1. (1) the executive (including the administrative), legislative, and judicial branches of the state; or
2. (2) a political subdivision (as defined in IC 5-10.3-1-6 ).
