This chapter applies only to a trustee acting under the authority of:

1. (1) a resolution adopted by the commission authorizing the trustee to conduct gambling operations under this chapter; and

2. (2) either of the following:

   1. (A) A written power of attorney approved by the commission under IC 4-33-6-2 (c), IC 4-33-6-22 , IC 4-33-6.5-2 (c), or IC 4-33-6.5-16 .
   2. (B) An appointment by the commission under IC 4-33-4-25 .
