"Key person" means any:

1. (1) officer;
2. (2) director;
3. (3) executive;
4. (4) employee;
5. (5) trustee;
6. (6) substantial owner;
7. (7) independent owner;
8. (8) agent; or

9. (9) any other individual adopted in rules under IC 4-22-2 ;

   of a business entity that has the power to exercise management or operating authority over the business entity or its affiliates.
