1. (a) At the hearing specified in the notice under section 7 of this chapter, the works board shall do the following:

   1. (1) Hear interested persons.
   2. (2) Decide whether the benefits that will accrue to the property liable to be assessed for construction of the system will equal the maximum estimated cost of construction of the system.
   3. (3) Determine the assessment against the property on which the system is constructed in an amount that does not exceed the engineer's estimate under section 8 of this chapter.
2. (b) If the works board finds that the benefits will not equal the maximum estimated cost of construction of the system, the board shall take no further action.
