As used in this chapter, "construction" includes repair, remodeling, renovation, or betterment, but only in instances when:

1. (1) a municipality acquires a sewage works that is in need of repair, remodeling, renovation, or betterment; and
2. (2) before the acquisition of the sewage works, the municipality was not responsible for the maintenance of the sewage works.
