"Accessory dwelling unit" means a self-contained living unit internal to or on the same lot or parcel as a single family dwelling that:

1. (1) does not exceed the lesser of:

   1. (A) seventy-five percent (75%) of the interior habitable area (gross floor area) of the single family dwelling; or
   2. (B) one thousand (1,000) square feet;
2. (2) includes its own cooking, sleeping, and sanitation facilities; and

3. (3) complies with or is otherwise exempt from any applicable building codes, fire safety codes, and other public health and safety laws.

   The term does not include a manufactured home (as defined in IC 36-7-4-1106 (b)) that is subject to the standards and requirements set forth in IC 36-7-4-1106 .
