Ind. Code § 35-47.5-5-3

Regulated explosives; persons convicted of felonies; prior unrelated convictions

A person who has been convicted of a felony by an Indiana court or a court of any other state, the United States, or another country and knowingly or intentionally:

  1. (1) possesses;
  2. (2) manufactures;
  3. (3) transports;
  4. (4) distributes;
  5. (5) possesses with the intent to distribute; or
  6. (6) offers to distribute;

    a regulated explosive commits a Level 5 felony. However, the offense is a Level 4 felony if the person has a prior unrelated conviction for an offense under this section.
