This chapter applies when the records kept in the recorder's offices of the various counties:

1. (1) contain records of instruments purporting to be deeds, mortgages, trust deeds, assignments, releases, or other instruments entitled to record by Indiana recording statutes; and

2. (2) the records of instruments described in subdivision (1) have been recorded in records other than those designated by statute for the recording of instruments.
